LEGAL ACCESS
UNDERSTANDING THE SECTION 21 PROCESS
Medical cannabis in South Africa is accessed through a regulated pathway overseen by SAHPRA (the South African Health Products Regulatory Authority). Patients must first be assessed by a licensed medical practitioner, who determines whether cannabis is an appropriate treatment option.
If suitable, the doctor applies for approval under Section 21, a legal provision that allows access to unregistered medicines on a named-patient basis. This ensures that all treatment is prescribed, monitored, and compliant with national regulations.
- Assessment by a licensed medical practitioner
- Doctor-led application submitted to SAHPRA
- Approval granted on a named-patient basis
- Prescription issued following Section 21 authorisation
- Access to regulated, quality-controlled cannabis products
